Common Music Group (UMG) and different publishers have reached a climactic level of their lawsuit towards Anthropic, urging a federal decide to rule that the substitute intelligence big was not legally allowed to make use of tens of millions of music lyrics to coach its Claude AI mannequin.

That query — which is on the coronary heart of dozens of lawsuits and will have trillion-dollar stakes for the booming expertise — is a straightforward one to reply, UMG and the opposite publishers write in Tuesday’s submitting.

“Anthropic is a $380-billion synthetic intelligence firm that scrapes and copies publishers’ copyrighted music lyrics on a large scale with out asking permission or paying a cent,” they write in a quick obtained by Billboard. “Anthropic’s actions are quintessential infringement — not truthful use.”

UMG, Harmony Music Group, ABKCO and different music firms sued Anthropic in 2023, making it one of many earliest music copyright instances. The case was later overshadowed by bigger litigation filed by all three main music firms towards Suno and Udio.

Greater than two years later, the publishers say it’s time for the courtroom to resolve the pivotal truthful use difficulty, arguing that the doctrine was not designed to defend “unabashedly business” exploitation of copyrighted works in a method that instantly competes with the originals.

“To be clear, this case will not be a referendum on AI expertise,” attorneys for the music firms write. “Publishers embrace the promise of lawfully created AI and have licensed their works to be used by quite a few AI firms. Publishers rightfully object, nevertheless, to Anthropic’s copying of their lyrics to construct an AI product that reproduces these lyrics and generates limitless AI rip-offs, all with out permission or fee.”

In an announcement to Billboard, a rep for UMG and the opposite plaintiffs stated that Anthropic had “dedicated copyright infringement on a large scale” and has by no means denied it.

“Having established that Anthropic copied and ingested songwriters’ lyrics with out permission or compensation, skilled its Chatbot (Claude) to serve up these lyrics on demand, and spit out AI-generated derivatives that compete instantly with human songwriters, the plaintiffs transfer for abstract judgement. The proof on this case is overwhelming.”

A rep for Anthropic didn’t instantly return a request for touch upon Tuesday.
